1. Acceptance of Terms

By accessing or using Date Busted ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We reserve the right to modify these terms at any time. Continued use after changes constitutes acceptance.

2. Description of Service

Date Busted provides a reverse face search service that allows users to upload a photograph containing a human face and receive results showing where similar faces appear across publicly available sources on the internet, including social media platforms, dating apps, news sites, and other public databases.

3. Eligibility

You must be at least 18 years old to use Date Busted. By creating an account, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these terms.

4. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use.

5. Prohibited Uses

Date Busted is a privacy and safety tool intended for lawful personal use such as verifying the identity of someone you are about to meet, checking for catfishing, or reconnecting with people you already know. You agree NOT to use the Service for any of the following:

• Stalking, harassment, intimidation, doxxing, or threatening any person
• Violating any person's privacy rights or applicable privacy or data-protection laws (including GDPR, CCPA, and similar)
• Discriminating against individuals based on race, gender, religion, sexual orientation, disability, or any other protected characteristic
• Unlawful background screening for employment, housing, credit, insurance, or any decision regulated by the U.S. Fair Credit Reporting Act (FCRA) or equivalent laws
• Any illegal activity, including identity theft, fraud, blackmail, or extortion
• Surveillance or profiling of individuals — including minors — without a lawful basis
• Searching for individuals you reasonably believe are minors (under 18)
• Building, training, or augmenting any facial-recognition database or AI/ML model
• Automated, scripted, or bulk searches via bots, scrapers, or unauthorised API access
• Reselling, sublicensing, redistributing, or commercially exploiting the Service or any search results
• Uploading photos you do not have a lawful right to use, or photos that contain illegal content (e.g. CSAM, non-consensual intimate imagery)

Date Busted is NOT a "consumer reporting agency" as defined by the FCRA, and our results may not be used in whole or in part to make decisions about a person's eligibility for credit, insurance, employment, housing, or any other FCRA-regulated purpose.

Violation of this section may result in immediate account termination without refund, forfeiture of unused credits, and where applicable, referral to law enforcement.

6. Credits, Payments & Refunds

Date Busted operates on a prepaid credit system. Credits are purchased in advance via Stripe and consumed when you unlock search results. Pricing is shown in your local currency at checkout and includes applicable taxes where required.

6.1 Standard refund policy

Because credits unlock digital content delivered immediately upon purchase, all sales are final and non-refundable once any credit from the purchase has been used to unlock results. Unused credit packs may be refunded within 14 days of purchase by emailing billing@datebusted.app from the email address on your account.

6.2 EU/UK consumer right of withdrawal

If you are a consumer resident in the EU or UK, you normally have a 14-day right of withdrawal under the EU Consumer Rights Directive (2011/83/EU) and the UK Consumer Contracts Regulations 2013. By starting to use the Service (i.e. unlocking your first result) before the 14-day period ends, you expressly request immediate performance and acknowledge that you will lose your right of withdrawal for the digital content already delivered. Unused credits remain refundable within 14 days as described above.

6.3 Chargebacks & duplicate charges

If you believe you were charged in error, contact us before initiating a chargeback — we resolve verified billing errors within 5 business days. Fraudulent or abusive chargebacks may result in account termination and forfeiture of any remaining credits.

6.4 Pricing changes

We reserve the right to change pricing at any time. Existing purchased credits remain valid regardless of price changes.

7. AI & Face-Matching Disclaimer

Date Busted uses automated facial-similarity algorithms ("AI matching") to compare the photo you upload against publicly available images on the internet. You acknowledge and accept the following:

• Probabilistic, not definitive. Match scores are statistical estimates of visual similarity, not legal proof of identity. A high score does not mean the matched profile belongs to the same person, and a low score does not mean it doesn't.
• False positives & false negatives occur. Lighting, angle, age, makeup, image compression, and demographic factors can all affect accuracy. Twins, siblings, and look-alikes may produce high-similarity matches.
• No guarantees of completeness. The Service searches publicly indexed sources only. Profiles set to private, recently created, deleted, or hosted on platforms we do not index will not appear, even if they exist.
• Not for high-stakes decisions. Do not use results as the sole basis for any decision that materially affects a person's life, livelihood, reputation, safety, or legal status. Always verify independently.
• Human review responsibility. You are the human decision-maker. Date Busted does not make any decision about any person — it surfaces public information for your review.

You agree to hold Date Busted harmless from any consequences arising from your interpretation of, reliance on, or actions taken in response to AI-generated match results.

8. Cookies & Consent

We use strictly necessary cookies to operate the Service (authentication, session, security, fraud prevention) on the basis of legitimate interest and contractual necessity. We use analytics and advertising cookies (Google Analytics 4, Google Ads, Microsoft Clarity) only with your consent, captured through our cookie banner and managed via Google Consent Mode v2.

You may withdraw or change your cookie consent at any time via the "Cookie settings" link in the footer. Full details — including providers, purposes, retention, lawful basis under GDPR Art. 6, and international data transfer safeguards — are available in our Privacy Policy. By using the Service you acknowledge that you have read our Privacy Policy and cookie disclosures.

7. Search Results

Search results are provided "as is." We do not guarantee the accuracy, completeness, or reliability of any search result. Match confidence scores are algorithmic estimates and should not be treated as definitive identification. You are responsible for independently verifying any information obtained through the Service.

8. Intellectual Property

The Service, including its design, code, algorithms, and branding, is owned by Date Busted and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service. Search results may contain content owned by third parties — you are responsible for respecting those rights.

9. Limitation of Liability

To the maximum extent permitted by law, Date Busted shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid to Date Busted in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free. We do not warrant the accuracy of search results.

11. Termination

We may suspend or terminate your account at any time for violation of these terms, suspicious activity, or any reason at our sole discretion. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. Any unused credits are forfeited upon termination for cause.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved in the courts of Delaware, USA.
